Terms of Service
Effective: 2026-04-28 Last updated: 2026-04-28 Last reviewed: 2026-04-28
These are the terms for using toody, a mood journal for iOS made by Lennard Behrends ("we" / "us"). By installing or using toody, you agree to these terms together with Apple's standard end-user licence that ships with every App Store install. They are short on purpose.
For the formal legal notice (Impressum) under §5 DDG, see /impressum.
the app and Apple's standard licence
toody runs on your iPhone or iPad. It helps you record moods, attach notes and photos, reflect on your day, and look back at patterns over time. Your data lives on your device and, when you are signed into iCloud, in your private CloudKit database. See the privacy policy for the full picture of what's stored and where.
When you install toody from the App Store, you are also bound by Apple's Licensed Application End User License Agreement ("Standard EULA"), which Apple ships with every App Store install. Where these terms and the Standard EULA overlap (license scope, permitted uses, restrictions, warranty, liability), the Standard EULA governs in addition to these terms. You can read the Standard EULA at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
These supplementary terms cover only the things specific to toody: subscriptions, acceptable use, medical disclaimer, intellectual property of your own content, and governing law.
your account
toody does not require an account. We do not ask for an email or password. Apple's iCloud account is used to sync your data across devices via your private CloudKit database. We do not control or have access to that storage. You can turn off iCloud sync for toody at any time in iOS Settings → [your name] → iCloud → Apps Using iCloud → toody.
subscriptions
toody offers an optional auto-renewing subscription that unlocks premium insights and features. The free tier of toody works without a subscription. Pricing for your storefront is shown on the in-app paywall before you confirm.
- Billing. Subscriptions are sold by Apple through your App Store account under Apple's Standard EULA linked above. You will be charged at confirmation, and again at each renewal until you cancel. We never see your payment-card data, your billing address, or your Apple ID email.
- Auto-renewal. Subscriptions auto-renew at the same period unless cancelled at least 24 hours before the period ends. Apple charges the renewal within 24 hours of the period end.
- Cancellation. Cancel any time in iOS Settings → [your name] → Subscriptions → toody → Cancel Subscription. Cancellation stops the next renewal; you keep premium access until the end of the period you already paid for.
- Refunds. Refund eligibility is decided by Apple under their App Store policy, requested at https://reportaproblem.apple.com/ . We cannot issue a refund directly.
- EU 14-day right of withdrawal. If you are an EU/EEA consumer, you have a 14-day right of withdrawal on a new subscription under the EU Consumer Rights Directive. Exercise it through Apple's refund flow above. By starting use of premium features immediately on subscribing, you consent to performance beginning before the 14-day period ends; this may limit the refund in line with Apple's policy and applicable consumer law.
- Lapse behaviour. If a renewal fails or you cancel, premium features lock at the end of the paid period. Your mood entries, notes, photos, and reflections are unaffected — they are yours, and the free tier continues to work.
- Receipt validation processor. Subscription state is validated through RevenueCat, Inc.; details and the data shared with them are in the privacy policy.
acceptable use
You agree not to:
- Reverse-engineer toody beyond what iOS allows for personal use.
- Use toody to harass, harm, or impersonate others. (toody is a private journal; there is no social surface, but the spirit of the rule applies if a future feature ever exposes one.)
- Attempt to bypass payment, paywall, or entitlement checks.
medical disclaimer
toody is not a medical device and not a substitute for professional care. Mood tracking, sleep correlations, and cycle information shown in toody are provided for self-reflection. They are not diagnoses and should not be used to make medical decisions. If you are in crisis or need clinical support, please contact a qualified professional or your local emergency services.
intellectual property
toody — including its name, logo, mascot, illustrations, copy, and source — belongs to Lennard Behrends. You receive a personal, non-transferable license to use the app on devices you own or control, as set out in Apple's Standard EULA linked above.
Your data — your mood entries, notes, photos, reflections — belongs to you. The license above covers the app, not your content. We do not claim any rights over what you record in toody.
warranty and liability
Warranty disclaimers and liability limitations relating to the app itself are governed by Apple's Standard EULA linked above and apply between you and Apple in the manner that EULA describes.
For anything specific to toody beyond what the Standard EULA covers, the following applies as far as German law allows:
- Nothing in these terms limits or excludes our liability for intent (Vorsatz), gross negligence (grobe Fahrlässigkeit), injury to life, body, or health, claims under the German Product Liability Act (Produkthaftungsgesetz), or any other liability that cannot be limited by contract.
- For breaches of essential contractual duties (Kardinalpflichten) — duties whose fulfilment is necessary to perform the contract and on which you may reasonably rely — we are liable for typical foreseeable damages.
- All other liability is excluded as far as the law allows.
- Your statutory consumer rights are not affected by anything in these terms.
changes
If we update these terms, we will revise the "Last updated" date at the top. Material changes will be surfaced inside the app on next launch and on this page. Continued use after a material change means you accept the updated terms; if you do not, you can uninstall the app (and, if you have an active subscription in a future version, cancel it via iOS Settings → [your name] → Subscriptions → toody).
governing law
These terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of the protections of the mandatory consumer-law rules of the country where you live.
