Terms of Service

These are the terms for using toody, a mood-tracker app for iOS made by Lennard Behrends ("we" / "us"). By installing or using toody, you agree to these terms together with Apple's standard end-user licence that ships with every App Store install. They are short on purpose.

the app and Apple's standard licence

toody runs on your iPhone or iPad. It helps you record moods, attach notes and photos, reflect on your day, and look back at patterns over time. Your data lives on your device and, when you are signed into iCloud, in your private CloudKit database. See the privacy policy for the full picture of what's stored and where.

When you install toody from the App Store, you are also bound by Apple's Licensed Application End User License Agreement ("Standard EULA"), which Apple ships with every App Store install. Where these terms and the Standard EULA overlap (license scope, permitted uses, restrictions, warranty, liability), the Standard EULA governs in addition to these terms. These supplementary terms cover only the things specific to toody: subscriptions, acceptable use, medical disclaimer, intellectual property of your own content, and governing law.

your account

toody does not require an account. We do not ask for an email or password. Apple's iCloud account is used to sync your data across devices via your private CloudKit database. We do not control or have access to that storage. You can turn off iCloud sync for toody at any time in iOS Settings → [your name] → iCloud → Apps Using iCloud → toody.

subscriptions

toody v1.0 ships with all features free. There is no in-app subscription, no in-app purchase, and no payment processing in this version of the app. You will not be charged for using toody v1.0.

When a paid subscription is added in a future version, this section will be materially updated to describe billing (handled by Apple through your App Store account), auto-renewal and cancellation, lapse behaviour, refund handling (which runs through Apple at https://reportaproblem.apple.com/ ), and your EU 14-day right of withdrawal where it applies. Apple's billing terms in the Standard EULA linked above will continue to govern the underlying purchase.

That update will count as a material change under "changes" below: a notice will surface inside the app on next launch and the effective date at the top of this page will be refreshed.

medical disclaimer

toody is not a medical device and not a substitute for professional care. Mood tracking, sleep correlations, and cycle information shown in toody are provided for self-reflection. They are not diagnoses and should not be used to make medical decisions. If you are in crisis or need clinical support, please contact a qualified professional or your local emergency services.

intellectual property

toody — including its name, logo, mascot, illustrations, copy, and source — belongs to Lennard Behrends. You receive a personal, non-transferable license to use the app on devices you own or control, as set out in Apple's Standard EULA linked above.

Your data — your mood entries, notes, photos, reflections — belongs to you. The license above covers the app, not your content. We do not claim any rights over what you record in toody.

warranty and liability

Warranty disclaimers and liability limitations relating to the app itself are governed by Apple's Standard EULA linked above and apply between you and Apple in the manner that EULA describes.

For anything specific to toody beyond what the Standard EULA covers, the following applies as far as German law allows:

changes

If we update these terms, we will revise the "Last updated" date at the top. Material changes will be surfaced inside the app on next launch and on this page. Continued use after a material change means you accept the updated terms; if you do not, you can uninstall the app (and, if you have an active subscription in a future version, cancel it via iOS Settings → [your name] → Subscriptions → toody).

governing law

These terms are governed by the laws of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of the protections of the mandatory consumer-law rules of the country where you live.
